01 Introduction
Welcome to Pakiter.
These Terms of Use govern access to and use of the Pakiter platform, operated by Pakiter LLC, registered in the state of Wyoming, United States, including the website, mobile application, systems, digital services, shipping features, payments, identity verification, communication, support and any related services.
By creating an account, accessing or using Pakiter, the user confirms that they have read, understood and accept these Terms.
If the user does not accept these Terms, they must not use the platform.
02 What is Pakiter
Pakiter is a digital intermediation platform that connects people who wish to send small items with verified travellers who already have a trip planned and available space to carry a package compatible with their route.
Pakiter promotes a sustainable crowdshipping model, based on the use of existing trips, seeking to reduce dedicated journeys, emissions and logistical waste.
Pakiter is not a traditional carrier, postal operator, courier, freight forwarder, bank, financial institution, employer of users or legal representative of travellers.
Pakiter acts as a technological intermediary between senders, travellers, recipients, payment service providers, identity verification providers and potential professional or institutional partners, where available.
03 Definitions
Pakiter — the company, application, website and digital services operated under the Pakiter brand.
Platform — the website, mobile application, software, systems, APIs, tools and services made available by Pakiter.
User — any person who accesses or uses Pakiter.
Sender — the user who requests the shipment of a package.
Recipient — the person designated to receive the package.
Traveller — the user who already has a trip planned and agrees to carry a package compatible with their route.
Casual Traveller — the traveller who uses the platform occasionally, without a professional or recurring nature.
Verified Recurring Traveller — the traveller who operates frequent routes or carries packages more regularly, subject to additional verifications.
Professional Partner — an individual or legal entity that regularly carries out an economic activity related to transport, delivery or logistics services and uses Pakiter under additional requirements.
Institutional Partner — a verified company, operator or entity that may, in the future, make routes, collection points, transport, storage or logistics services available through Pakiter under a specific contract.
Package — the lawful, permitted, declared and accepted item for transport through the platform.
Prohibited Items — goods that cannot be sent through Pakiter.
PSP — regulated payment service provider used to process payments, holds, refunds and withdrawals.
KYC — user identity verification process.
AML — prevention of money laundering, illicit financing, fraud and misuse of the platform.
04 Nature of the service
Pakiter allows senders to publish shipping requests and verified travellers, with already planned trips, to accept carrying packages compatible with their route, available space and transport conditions.
The service aims to facilitate person-to-person shipping, make use of existing trips, reduce costs, reduce environmental impact and increase security through verification, traceability and digital payments.
The traveller declares that the trip registered on the platform was already planned before accepting the package and that carrying the package is incidental to their main trip.
Pakiter does not guarantee that there will always be available travellers, that all requests will be accepted or that a given shipment will be completed within a specific timeframe, unless expressly stated.
05 Eligibility
To use Pakiter, the user must be at least 18 years old, have the legal capacity to enter into contracts, provide truthful, complete and up-to-date information, use authentic documents, comply with applicable law, accept these Terms, the Privacy Policy and the Cookie Policy, and respect the rules on security, community, payments and permitted items.
Pakiter may refuse, suspend or close accounts where there are indications of fraud, legal risk, misuse, breach of these Terms or failure in verification processes.
06 User account
The user is responsible for maintaining the security of their account, password, devices and authentication means.
It is prohibited to create fake accounts, use a third party's identity, sell or transfer accounts, create multiple accounts to circumvent limits, use false or manipulated documents, or allow another person to use their account.
Pakiter may require additional verification at any time.
07 Identity verification
Pakiter may request information and documents to verify identity, prevent fraud and protect the platform, including legal name, date of birth, identity document, selfie, proof of life, phone, email, address, tax number, country of tax residence, IBAN in the user's own name, proof of address and proof of professional activity, where applicable.
Access to certain features, including accepting packages, receiving payments, withdrawing funds or increasing limits, may depend on the successful completion of verification.
08 Traveller categories
Pakiter may classify travellers based on frequency of use, amounts received, number of deliveries, repeated routes, history and risk profile.
8.1. Casual Traveller
Profile for users who carry packages occasionally, making use of already planned personal trips.
8.2. Verified Recurring Traveller
Profile for users who operate frequent routes for their own reasons, such as work, study or family, and who accept carrying packages compatible with those trips.
This profile may require enhanced KYC, tax number, validated IBAN, confirmation of tax residence, volume limits, acceptance of tax obligations and manual review.
8.3. Professional Partner
When use of the platform indicates regular, organised or professional economic activity, Pakiter may require the user to operate as a Professional Partner.
Pakiter may request proof of active business, commercial registration, tax number, insurance, professional documentation and compliance with specific rules.
While professional verification is not complete, Pakiter may limit the account, block new deliveries or withhold withdrawals as permitted by law.
09 Pre-existing trips and sustainability
The traveller declares that the trip was already planned for their own reasons, that they did not create the trip exclusively to carry the package (unless operating as an authorised professional partner), that the indicated route is truthful, that the indicated mode of transport is truthful, and that they will respect the deviation, time and safety limits set by Pakiter.
Pakiter may block false routes, artificial trips, excessive deviations or behaviour incompatible with the platform's sustainable model.
Pakiter promotes the use of already existing trips to reduce dedicated journeys, emissions and logistical waste. Users must use the platform in a manner consistent with this principle.
Pakiter may calculate estimates of environmental impact, avoided CO₂, optimised kilometres and other sustainability metrics. These estimates are informational and may vary depending on methodology, available data and mode of transport.
10 Sender responsibility
The sender is responsible for correctly declaring the contents of the package, ensuring the item is permitted, properly packaging the package, indicating realistic weight, dimensions and value, providing correct collection and delivery data, ensuring they have the legal right to send the item, complying with applicable laws and not sending prohibited, dangerous, illegal or undeclared items.
The sender declares that they are of legal age, uses their true identity and is the legitimate owner of the package or has authorisation to send it.
The sender acknowledges that they may be held liable for damages, losses, costs, penalties, claims or legal consequences caused by false declaration of contents, sending a prohibited item, inadequate packaging, incorrect information, false declared value, incorrect recipient data, attempted fraud, violation of law or concealment of relevant information.
When creating a shipping request, the sender may be required to accept a specific declaration of responsibility, via checkbox, confirmation button, digital signature, OTP or other electronic mechanism.
11 Traveller responsibility
The traveller is responsible for carrying the package with reasonable care, keeping the package closed and intact, not opening, altering, exchanging, using or damaging the package, communicating delays or incidents, delivering the package to the indicated recipient or authorised person, following reasonable platform instructions, refusing suspicious, poorly packaged or undeclared items, and complying with legal, tax and safety obligations.
The traveller is not a worker, employee, agent, representative, driver, courier or subordinate worker of Pakiter.
12 Permitted items
In the MVP, Pakiter may limit shipments to low-risk items, including permitted documents, clothing, footwear, books, accessories, small personal objects, small electronics, simple gifts and low-risk non-perishable products.
Pakiter may apply weight, dimension, value and category limits.
Pakiter may refuse or cancel any shipment where there are doubts about legality, safety, packaging, value, risk or compliance.
13 Prohibited items
It is prohibited to send through Pakiter cash, cheques, third-party bank cards, loaded prepaid cards, financial instruments, gold, precious metals or precious stones without authorisation.
It is prohibited to send illegal drugs, cannabis, THC, CBD where prohibited or regulated, psychotropic substances or products used for drug consumption or production.
It is prohibited to send firearms, ammunition, explosives, prohibited knives, regulated bladed weapons, tasers, prohibited defensive sprays, fireworks, flammable materials, fuels, dangerous chemicals or radioactive materials.
It is prohibited to send counterfeit goods, false documents, stolen property, pirated products or items that infringe intellectual property.
In Pakiter's initial phase, the following are prohibited: meat, fish, shellfish, dairy, fresh produce, frozen goods, perishable products, unpackaged homemade food, products requiring refrigeration and products subject to complex veterinary, sanitary, phytosanitary or customs controls.
It is prohibited to send prescription medicines, controlled substances, hormonal substances, vaccines, blood or biological material, medical samples and restricted medical devices.
It is prohibited to send live animals, parts of protected animals, regulated plants, regulated seeds, protected species and prohibited wildlife products.
It is prohibited to send child sexual abuse material, illegal pornography, illegal extremist material, materials inciting violence or terrorism and goods prohibited by sanctions.
Unless specifically authorised by Pakiter, the following are prohibited: high-value jewellery, works of art, antiques, very expensive equipment, unique irreplaceable documents and fragile items without professional packaging.
Pakiter may cancel shipments, suspend accounts or report to authorities where there is suspicion of illegal activity.
14 Packaging
The sender is responsible for correctly packaging the package.
Packaging must be appropriate for the type of item, weight, fragility, route and mode of transport.
The package must be sealed, protected against reasonable damage, not leaking, not emitting a strong odour, not posing a risk to the traveller, other users or third parties, and capable of being transported without undeclared special handling.
Pakiter, the traveller or any partner will not be liable for damage caused by inadequate, insufficient or misleading packaging.
15 Payments
Payments are processed through regulated payment service providers.
Pakiter may charge a service fee, commission, processing fee, cancellation fee, insurance fee where applicable and other charges disclosed before confirmation.
The traveller may only withdraw funds to a bank account in their own name, after the necessary verification.
Pakiter may temporarily withhold payments where there is a dispute, suspicion of fraud, KYC non-compliance, AML investigation, chargeback, claim or legal obligation.
Payments outside the platform are prohibited, unless expressly authorised by Pakiter.
16 Cancellations and refunds
The sender may cancel before the package is collected. Depending on the timing of cancellation, fees may apply.
- Before the traveller accepts — 100% refund, except non-refundable processing fees charged by third parties, where applicable.
- After acceptance, before collection — partial or 100%, depending on timing.
- Very close to collection — a fee may apply.
- After collection — subject to review.
The traveller must cancel only for legitimate reasons. Repeated, abusive or unjustified cancellations may reduce visibility, limit the account or result in suspension.
If the sender does not show up, provides incorrect data or does not deliver the package at the agreed time, they may not receive a full refund.
There is no guarantee of refund, compensation or protection for shipments containing prohibited, illegal, falsely declared or dangerous items.
Nothing in these Terms limits mandatory legal consumer rights.
17 Proof of collection and delivery
Pakiter may require proof of collection and delivery, including confirmation code, QR code, photograph, digital signature, app confirmation, geolocation, internal messages and recipient confirmation.
The absence of adequate proof may affect payments, refunds and dispute resolution.
18 Disputes
Any complaint relating to a delivery must be reported through the platform within a maximum of 24 hours after the delivery is marked as completed, unless duly justified impossibility.
In the event of a dispute, Pakiter may analyse messages, location, proof of collection, proof of delivery attempt, recipient data, photographs, videos, evidence, user history and behaviour of the parties.
The resolution may include a new attempt, return, partial refund, compensation, payment hold or closure of the dispute.
Pakiter may mediate the situation but does not guarantee a favourable resolution for either party.
19 Fraud prevention, KYC and AML
Pakiter may monitor accounts, transactions and usage patterns to prevent fraud, money laundering, illicit financing, tax evasion, fake accounts, fictitious packages, use of false documents and platform abuse.
Pakiter may apply transaction limits, withdrawal limits, enhanced verification, manual review, account suspension, payment holds, feature blocking and reporting to authorities as required by law.
Risk signals include, among others, multiple accounts linked to the same IBAN, false or repeated routes without justification, abnormally high amounts, fictitious deliveries, recurring sender and recipient without a clear purpose, attempts to circumvent limits, multiple small payments with a suspicious pattern and use of false or inconsistent documents.
20 Tax obligations
Each user is responsible for fulfilling their tax obligations in their country of residence, activity or taxation.
Amounts received through Pakiter may constitute taxable income.
Pakiter may request tax data, retain records and report information to tax authorities as required by law.
Pakiter does not provide individual tax advice. The user should consult an accountant, tax adviser or competent authority if in doubt.
21 Community rules
All users must act with respect, honesty, safety, responsibility, transparency, punctuality and care for others' belongings.
It is prohibited to insult, threaten, intimidate, harass, discriminate, use offensive language, pressure other users, make inappropriate proposals, act aggressively, manipulate reviews, attempt payments outside the platform, create fake shipments, simulate deliveries, manipulate location or use the platform for illegal purposes.
Pakiter may remove content, limit accounts, suspend users, withhold payments or report to authorities when necessary.
22 User-Generated Content
Users may upload, submit, publish or make available content on Pakiter, including profile photos, item photos, order descriptions, messages, reviews, delivery instructions, proof of delivery, documents or other information required for the platform to operate.
Users retain ownership of any content they upload to Pakiter. However, by uploading or making content available on the platform, users grant Pakiter a limited, non-exclusive, worldwide, royalty-free licence, transferable only where necessary to service providers or operational partners, to use, host, store, reproduce, display, transmit, technically adapt and process such content solely to the extent necessary to operate, protect, improve and deliver Pakiter's services.
Users represent and warrant that they hold all rights, authorisations and permissions required to upload, share or make available such content on Pakiter, and that such content does not infringe any third-party rights, applicable laws, intellectual property rights, image rights, privacy rights, confidentiality obligations or any platform rules.
Users must not upload, submit or share content that is false, misleading, illegal, offensive, discriminatory, abusive, threatening, sexually explicit, fraudulent, that infringes third-party rights, that exposes personal data of third parties without authorisation, or that relates to prohibited items, illegal activities or misuse of the platform.
Pakiter may remove, hide, restrict or moderate content where it determines that such content violates these Terms, applicable law, third-party rights, safety rules, community guidelines, or where necessary to prevent fraud, protect users, resolve disputes or fulfil legal obligations.
Pakiter does not claim ownership over content uploaded by users, but may retain certain content or records where necessary for payments, disputes, security, fraud prevention, legal compliance, defence of rights or enforcement of these Terms.
23 Reviews
Pakiter may allow reviews between users.
Reviews must be truthful, respectful and based on real experiences.
Pakiter may remove false, abusive, discriminatory, offensive or manipulated reviews.
It is prohibited to threaten negative reviews to gain an advantage.
24 Personal data and privacy
The processing of personal data is governed by Pakiter's Privacy Policy.
Pakiter may process personal data to create accounts, verify identity, process payments, confirm shipments, prevent fraud, resolve disputes, fulfil legal obligations and improve the platform.

25 Cookies
The use of cookies and similar technologies is explained in Pakiter's Cookie Policy.
The user should consult the Cookie Policy available at pakiter.com/legal/cookies.
26 Insurance and protection
Pakiter may offer insurance, limited protection or compensation for certain shipments, subject to specific conditions.
Some items, values, routes or modalities may be excluded from coverage.
The user should check the applicable conditions before confirming the shipment.
27 Relationship between parties
Nothing in these Terms creates an employment, agency, partnership, representation, franchise or subordination relationship between Pakiter and users.
The traveller acts independently and is responsible for their legal, tax and personal obligations.
Pakiter does not control how the traveller undertakes their trip, except for rules necessary for the platform's security, quality, sustainability and legal compliance.
28 Limitation of Pakiter's liability
To the maximum extent permitted by law, Pakiter is not liable for false information provided by users, the actual contents of packages, users' tax non-compliance, acts or omissions of users, inadequate packaging, delays caused by traffic, weather, strikes, force majeure or third parties, loss of profits, opportunities or indirect damages, misuse of the platform, temporary unavailability of the application or third-party failures.
Nothing in these Terms limits liability that cannot be limited by law.
29 Account suspension and termination
Pakiter may suspend or close accounts in cases of breach of these Terms, suspicion of fraud, AML risk, false documents, prohibited items, abusive behaviour, tax or legal non-compliance, order from a competent authority or risk to the security of the platform or third parties.
The user may request account closure, subject to completion of shipments, disputes, legal obligations and data retention periods.
30 Changes to these Terms
Pakiter may amend these Terms to reflect legal, technical, commercial or operational changes.
When material changes are made, Pakiter may notify users by email, app or website.
Continued use of the platform after the changes take effect constitutes acceptance of the new Terms.
31 Governing law and dispute resolution
These Terms are governed by the law of the place of incorporation of Pakiter LLC, except for mandatory consumer protection rules applicable in the user's country of residence.
The parties should attempt to resolve disputes amicably through Pakiter's support.
Where applicable, the user may have recourse to competent courts or alternative dispute resolution bodies.
